Terms of Use

1. Acceptance
These Terms govern the use of the platform of Comissão de Festas São João de Sobrado 27, with registered office at Tasquinha de São João, Largo do Passal, 4440-337 Sobrado, Valongo, Portugal. By using the platform, the user fully accepts these Terms.
2. Ticket Purchase
- Tickets may only be purchased through this platform or through in-person/authorized channels expressly disclosed by the Organization.
- Each purchase requires truthful, up-to-date and sufficient data for contact, validation, invoicing, fraud prevention and ticket issuance.
- The Organization may refuse, suspend or cancel requests where there are reasonable indications of fraud, abuse, duplication, identity misuse or breach of these conditions.
3. Payment
- Payment is made through the methods made available at the time of purchase, including MB WAY where applicable, using the details shown during the process.
- Payment validation may depend on manual confirmation, anti-fraud verification or operational reconciliation before final ticket issuance.
- Purchases that are unpaid, paid after the deadline, made with an incorrect amount or lacking sufficient identifying elements may be automatically cancelled or kept pending until clarified.
4. Cancellations and Refunds
- Cancellation or correction requests must be communicated as soon as possible to organizacao@saojoaodesobrado.pt.
- Unless mandatory law provides otherwise or the Organization expressly decides otherwise, refund requests, no-shows, buyer mistakes or personal inability to attend are assessed case by case and do not automatically create a right to reimbursement.
- In case of total event cancellation on the Organization’s initiative or a supervening legal impossibility attributable to it, the legally applicable solution will be ensured, including reimbursement where due.
5. Ticket Usage
- Each ticket has a unique, personal QR code for single use and may be invalidated after reading, justified administrative cancellation or detection of duplication.
- The ticket must be presented in readable format and, when requested, accompanied by minimum elements allowing confirmation of legitimate access.
- Resale, abusive transfer, reproduction, manipulation, automated use or any attempt to circumvent validation mechanisms may result in ticket cancellation and refusal of entry.
6. Ticket cancellation and refunds
Refund eligibility depends on objective and verifiable criteria, listed below, with no discretionary case-by-case assessment:
- Total cancellation of the event by the Organisation: full refund.
- Postponement to a date materially different from the original: the user may choose between automatic validity for the new date or a full refund.
- Documented platform technical error during purchase (duplicate charge, ticket not issued after confirmed payment): full refund.
- Extreme weather conditions causing event interruption, as officially declared by competent authorities (Civil Protection or IPMA): proportional refund.
- Outside these situations — and given that this is a leisure service with a specific date of performance — the exception to the right of withdrawal under Art. 17(1)(m) of Decree-Law 24/2014 applies.
7. Limitation of liability
Comissão de Festas's liability for direct, demonstrable damage caused to the user is limited to the amount actually paid for the relevant services, except where mandatory law excludes such limitation. In particular, this limitation does NOT apply:
- To wilful misconduct or gross negligence.
- To damage to life, physical integrity or health.
- To consumer rights that are legally non-waivable (Law 24/96 and Decree-Law 67/2003).
8. Intellectual property and automated use
All site content (text, images, video, code) is protected by intellectual property rights. Reproduction, systematic extraction or commercial use without written authorisation is prohibited.
- Mass scraping, reverse engineering, decompilation or circumvention of technical protection measures is prohibited, except where legally permitted (in particular, text and data mining exceptions for scientific research under Directive (EU) 2019/790 and Law 36/2023).
- Indexing by legitimate search engines that respect the site's robots.txt is permitted.
- Quotation for informational, critical or educational purposes is permitted with attribution to source and author.
9. Governing law and jurisdiction
Portuguese law applies. The courts of Porto have exclusive jurisdiction for any dispute, with express waiver of any other, except where mandatory law sets a different forum (notably in consumer matters).
11. User-Generated Content (UGC) — Limitations
The "Memórias" section and any other areas that allow user submissions operate as a participatory archive. The Organization acts solely as a technical host of such content and:
- Does not verify, validate or certify the authenticity, authorship, dating, historical context, integrity, accuracy, description, captioning or licensing of submitted content.
- Has no technical, human or legal means to guarantee that each photo, video, text, name, date or identification matches reality or has the consent of every person depicted.
- Assumes no responsibility for statements, opinions, attributions, misidentifications, omissions, reputational harm or damages arising from third-party content.
- Editorial moderation, where it exists, is discretionary, post-submission and limited to a reasonable triage; its existence does not turn the Organization into an editor nor imply validation of the approved content.
- Content may be refused, unpublished, edited (e.g. captions, metadata) or removed at any time, without notice, on legal, ethical, technical, editorial or legitimate third-party complaint grounds.
12. User Warranties and Indemnification
By submitting any content, the user expressly represents, under their sole responsibility, that:
- They are the original author or hold all necessary rights, authorizations, licences and consents (including copyright, neighbouring rights and image rights) to share the content on the platform.
- They have obtained informed consent from identifiable persons depicted and, where minors or vulnerable persons are involved, from their legal representatives.
- The content is not false, misleading, defamatory, insulting, discriminatory, sexually explicit, violent, unlawful, offensive, does not violate the privacy of others or infringe third-party rights.
- They do not submit sensitive personal data of third parties (health, religion, political views, etc.) without a proper legal basis.
- They agree to indemnify and hold harmless Comissão de Festas, the Organization, its staff and partners from any claims, complaints, judicial or administrative proceedings, fines, legal costs and damages arising from the submitted content or breach of these warranties.
13. Notice & Takedown Mechanism
Anyone who considers that published content infringes their rights (image, authorship, privacy, honour, personal data, etc.) may request its removal:
- By sending a substantiated communication to organizacao@saojoaodesobrado.pt identifying the content (URL or description), the complainant, the rights invoked and reasonable proof of standing.
- The Organization undertakes to assess legitimate requests within a reasonable time and to remove or hide contested content whenever there is well-founded doubt, without such removal implying any acknowledgement of liability.
- Manifestly abusive, baseless or repetitive requests, or those aimed at silencing legitimate historical record, may be denied or referred for appropriate review.
14. Minors
Account creation and content submission require legal majority (18 years) or express authorization from a legal representative. The Organization does not knowingly collect data from minors without such authorization and will remove such data as soon as it becomes aware of its existence without legal basis.
15. Governing Law and Jurisdiction
These Terms are governed by Portuguese law. Any dispute shall be subject to the courts of the district of the Organization's seat, without prejudice to mandatory consumer protection rules and the possibility of resorting to legally competent alternative dispute resolution bodies.
